Who is liable for use of the tissue?

Researchers and their institutions are presumed liable for the inappropriate use of the tissue. No legal cases have yet established liability at present for repositories. Still, all research on tissues should have IRB approval, and that approval should be documented for the hospital and the repository company prior to release of the tissue to the researcher.
